Flightbase is a product of Adventurebase GmbH.
Flightbase's deliveries, services, offers and brokerage are based exclusively on these terms and conditions. The version in German is legally binding.
By ordering a voucher or registering for an experience, these terms and conditions are deemed to have been accepted. The order or registration can be made in writing or verbally. The person ordering or registering is obliged to inform the other participants (in the case of a registration for several persons) and/or the persons receiving the gift (in the case of a gift voucher) of these General Terms and Conditions. General terms and conditions of the purchaser are hereby rejected.
Flightbase organizes and arranges flight experiences throughout Switzerland and nearby countries with various operators. The bookings are made through the sale of value vouchers or through direct placement.
Only value vouchers are available. The value is shown on the invoice and can be requested at any time. Value vouchers can be freely credited to any Flightbase offer within the validity period. An offer chosen by the customer can be described and printed on the voucher, but this is not binding for redemption.
4.1 Brokerage contract
The brokerage contract is created when the buyer places an order or registers on the website and accepts the general terms and conditions. An order by telephone or e-mail replaces the order by online form. The organizer alone is responsible for the implementation. In this case, Flightbase is the agent and not the organizer. When registering for the flight experience, the customer receives the contact details of the organizer and concludes a separate contract with the organizer for the performance. This contract for the use of the respective experience is concluded directly between the participant in the experience and the respective experience partner (organizer). The legal relationship between the customer and the experience partner (organizer) is governed exclusively by the general terms and conditions of the experience partner. Vouchers are credited against the experience partner's offer.
4.2. Sales documents
The information in our sales documents (descriptions, drawings, illustrations, dimensions, weights and other services) are to be understood as guidelines only and do not constitute a guarantee of properties, unless they are expressly designated as binding in writing. Flightbase accepts no responsibility for product information provided by partners.
4.3 Advice from AI
In certain areas, such as customer chat, customer inquiries are answered by AI. The answers given by the AI may contain errors and are therefore only to be understood as initial information. If anything is unclear, the correct employee can be requested at any time.
Prices are subject to change and printing errors excepted.
6.1 Payment for vouchers
Payment for vouchers is made by invoice or online payment. Vouchers are only valid after receipt of the full invoice amount and can be credited to an offer. The payment term of the invoice remains the same in this case.
6.1.1 Payment of vouchers by installment
Vouchers can be paid for in installments under the following conditions:
- The request for payment by installments must be entered in the comments field when ordering the voucher.
- The first installment must be at least 1/4 of the total amount and must be paid within 30 days of completing the order.
- The remaining installments can be chosen freely. The remaining installments can be chosen freely, but the total amount must be paid no later than 12 months after completion of the order.
- Direct registrations cannot be paid in installments.
6.2 Payment of registrations
Payment for direct registrations is made by invoice or online payment and must be made at least 3 days before the event. If the customer fails to make the payment on time, Flightbase may cancel the activity. In this case, however, the customer is not released from their contractual obligations to register and the cancellation fees will be charged.
6.3. Payment from abroad
Bank charges for bank transfers from abroad are to be borne by the customer. The voucher or registration will not be activated until the invoice amount has been paid in full.
7.1. Validity of vouchers
The value of the voucher remains valid for 10 years in accordance with the Swiss Code of Obligations. During these 10 years, each voucher can be redeemed for any Flightbase and Adventurebase offer.
7.2. Extension
The value of the voucher can be extended free of charge in increments of one year up to a maximum of 10 years.
7.3. Cash payment
Cash payment of the voucher value is excluded. This also applies if the originally selected experience is no longer available in whole or in part or is no longer desired by the customer. In such a case, the voucher value can be used for any other experience from the Flightbase range.
7.4. Transferability
Gift vouchers are freely transferable and are not issued to a specific person. In the event of loss or theft of a voucher, Flightbase accepts no liability for unlawful redemption.
7.5. Validity of registrations
When registering for a specific experience, the offer price valid at the time of registration (registration date) applies. This price is guaranteed for the duration of the experience for a period of at least 6 months after the registration date.
If an experience voucher used for registration has an explicit, longer price guarantee, this longer period replaces the basic guarantee period. The prerequisite for this is that the registration (booking) is made within the valid price guarantee period and that the voucher covers the entire experience at the time of registration.
If the experience takes place after the expiry of the respective valid guarantee period and the current offer price for the experience has risen in the meantime, the difference to the price valid at the time of registration may be charged as a surcharge.
7.6. Availability of experiences
Flightbase always endeavors to keep the range of experiences up to date. If a specific partner discontinues its offer or withdraws from the Flightbase program, the voucher retains its full value and can be applied to any other experience from the Flightbase portfolio. This does not give rise to a claim for a refund.
8.1 Shipping costs in Switzerland
Shipping costs for sending vouchers in Switzerland are borne by Flightbase. There are no extra costs for the customer.
8.2. Shipping outside Switzerland
Vouchers are available abroad as a download. No vouchers are delivered abroad by post.
8.3 Delivery and performance times
Delivery dates and delivery times are non-binding, unless expressly agreed otherwise in writing. The specification of certain delivery periods and delivery dates by Flightbase is subject to the correct and timely delivery to Flightbase by suppliers and manufacturers.
8.4. Default of acceptance
If the buyer refuses to accept the delivery items after the expiry of a grace period set for him or declares that he does not wish to accept the goods, Flightbase can refuse to fulfill the contract and demand compensation for non-fulfillment. Flightbase is entitled to demand either a lump sum of 25% of the agreed purchase price or compensation from the buyer for the actual loss incurred.
8.5. Defects
Visible differences in quantity must be reported to Flightbase and the carrier in writing immediately upon receipt of the goods, hidden differences in quantity within 4 days of receipt of the goods. Complaints regarding damage, delay, loss or poor packaging must be made immediately upon receipt of the consignment.
8.6. Transfer of risk
The risk is transferred to the buyer as soon as the consignment has been handed over to the person carrying out the transport. If shipment is delayed or becomes impossible through no fault of our own, the risk is transferred to the buyer upon notification of readiness for shipment. If Flightbase assumes the transportation costs, this has no influence on the transfer of risk.
9.1 Return of vouchers
Vouchers can be canceled up to 20 days after the order date for a processing fee of CHF 25 per voucher. If the voucher has not yet been sent, the processing fee does not apply. The vouchers do not have to be returned to Flightbase.
9.2 Excluded from returns
Products that are not directly related to the voucher cannot be returned.
9.3 Exchange / crediting of vouchers
The value of the voucher can be credited to a new voucher order or to a new registration for any Flightbase offer during the validity period.
10.1. Registrations
Registrations are binding. To protect yourself in case of illness, accident, etc., we recommend that you take out travel cancellation/cancellation insurance. It is the customer's responsibility to take out this insurance.
10.2. Cancellations and postponements of registrations
Appointments can be canceled or postponed in writing using the appropriate web form. Only written cancellations or postponements via the web form during business hours from 8:00 a.m. to 5:00 p.m. Monday through Sunday will be accepted. Cancellations made outside of business hours will be dated to the next possible business hour. The date of receipt of the declaration by Flightbase is decisive. Cancellations by telephone, email, WhatsApp, or other channels other than the corresponding web form are not valid.
10.3. Group registrations
When registering groups (multiple people), the person making the registration is responsible for passing on these terms and conditions to all participants and is liable for any cancellation costs incurred by all participants.
10.4. Cancellation/postponement by Flightbase
Flightbase and its partners may cancel or postpone confirmed appointments for important reasons (in particular weather and safety reasons, technical reasons, illness of the pilot, cancellation by other participants, etc.). This may happen at very short notice, even immediately before take-off. Any additional costs for travel, meals, etc. shall be borne by the participant and will not be covered by Flightbase. Such a postponement does not constitute a breach of contract, but is part of the nature of the experience.
In the event of cancellation by Flightbase, the dates will be postponed to a new date requested by the customer. Automatic postponement to the second date requested during registration or a provisional reservation of the second date requested is not possible.
The voucher or ticket remains fully valid for a new booking within 12 months of the cancellation. The customer can enter the new desired date using the postponement form. A refund of the purchase price is generally excluded in the event of such a postponement. The booking will only be canceled if the customer has indicated in the relevant field during registration that no postponement is possible for them. In this case, vouchers can be credited to another experience. For registrations without a voucher, the offer price paid (which was explicitly paid for this registration) will be refunded after deduction of items that are not directly related to the activity.
11.1 Unless special provisions are listed in the following sections, the following provisions apply to all offers:
- Up to 24 hours before the booking: Cancellation or postponement is possible free of charge.
- Less than 24 hours before the booking: The registration expires. Cancellation or postponement is no longer possible.
11.2 Special provisions for parachute offers
Triengen:
- Up to 8 days before the booking: CHF 50.
- 8 to 3 days before the booking: CHF 125.
- From 24 hours before the booking: Registration expires.
Beromünster Tandem jumps:
From 72 hours before the booking: Registration expires.
Beromünster – AFF first jumps:
From 7 days before the booking: Registration expires.
Reichenbach:
From 48 hours before the booking: Registration expires
11.3 Special regulations for balloon flights
All regions not mentioned:
From 48 hours before the booking: Registration expires.
Region of Eastern Switzerland, Graubünden, Bern, Biel:
From 72 hours before the booking: Registration expires.
Regions of Fribourg, Geneva, Lausanne:
- Single seats: No cancellation possible. The registration is valid for 24 months. In case of cancellation due to weather conditions, the registration is extended by 4 months.
- Groups of 13 or more people: booking up to 31 days before booking ; 30 to 15 days before booking of the offer price; from 15 days: Registration expires.
Schaffhausen region:
From 7 days before booking: Registration expires.
11.4 Special rules for fighter jet flights
- Up to 5 days before booking: 35% of the offer price
- From 5 days before booking: Registration expires.
11.5 Special rules for heliskiing:
- From 48 hours before booking: Registration expires.
11.6 Special rules for paragliding Zurich Incredible:
From 72 hours before the booking: Registration expires.
11.7 Special regulations for gyrocopter sightseeing flights:
- Up to 24 hours before the booking: CHF 50.
- From 24 hours before the booking: Registration expires.
11.8 Special regulations for flight simulator appointments at Zurich Airport:
From 48 hours before the booking: Registration expires.
11.9 Special rules for flight simulator appointments in Münchenwiler (BE)
Cancellations 72 hours or less before booking confirmed booking: 100% of the offer price.
11.10 Special rules for sightseeing flights and introductory flights from Buttwil:
Cancellations 48 hours or less before booking confirmed booking: 100% of the offer price.
11.11. Special regulations for helicopter flights from Bern Belp
Postponement possible up to 7 days (168 hours) before the confirmed booking
Note: Depending on the assigned pilot/guide, the cancellation deadlines may vary slightly. The applicable cancellation conditions are always visible in the registration overview. Times are always calculated in hours.
12.1. Flight times and offer description
The flight times stated in the product descriptions and registration confirmations are approximate and may vary during the activity depending on weather, wind, and safety conditions. Take-off locations and activity locations may also be changed at short notice by the pilot for weather and safety reasons. If an activity is terminated early by the customer, the activity is still considered to have been completed. In special cases, the pilot may terminate an activity early for safety reasons or due to the condition of a passenger, in which case the activity shall also be deemed to have been carried out. If the passenger booking for booking under the influence of drugs or alcohol, the activity will be refused and deemed to have been carried out.
12.2. Weather decision
The weather decision will be communicated to the customer by the pilot in accordance with the information provided in the confirmation email. In case of uncertain weather, the weather decision may also be made at shorter notice. Even before the actual weather decision is made, the customer has the opportunity to obtain information about the weather trend from the pilot or base manager.
12.3. Duty to communicate and availability for the weather decision
The pilot or guide is the primary contact person for the operational execution and the weather decision. The method of contact specified in the registration confirmation is binding for both parties. Depending on the information provided, the following applies:
1. If the customer must contact the pilot:
The customer is obligated to actively contact the pilot at the agreed time using the contact number provided.
2. If the pilot contacts the customer:
The customer is obligated to be available at the specified time at the telephone number provided during booking (via call, text message, or common messenger services).
If the agreed contact cannot be established at the specified time (because the pilot is demonstrably unavailable or the pilot does not report as announced), the customer is obliged to contact the Flightbase head office immediately on +41 71 554 80 70 during the published opening hours. If the customer fails to fulfill their obligation to cooperate (actively establishing contact or being available, as well as reporting immediately if contact is not established), the service shall be deemed to have been canceled by the customer if the flight is not performed, and the voucher/ticket shall be deemed to have been redeemed. In this case, there shall be no entitlement to a refund or free rebooking.
12.4. Participant requirements
In order to participate in certain experiences, there are specific physical requirements, such as maximum body weight and maximum height. It is the participant'sresponsibility to check and comply with these requirements. The specific restrictions can be viewed for each experience. If a guest is rejected on site due to these physical requirements, the voucher or ticket and the right to the booked experience will be forfeited.
12.5. Punctuality of the customer and consequences of late arrival
The meeting time communicated in the registration confirmation is binding for the customer. The activities are tied to tight time slots that depend on weather conditions, approvals, or subsequent bookings, etc.
If the customer is late, the safe and scheduled execution of the activity can no longer be guaranteed. The pilot or guide on site is therefore entitled to start the activity without the late customer or to cancel it. In this case, the service is considered not to have been used by the customer (so-called no-show). The right to participate expires without replacement and the voucher or ticket is considered redeemed. There is no entitlement to a refund or a free postponement of the appointment.
13.1. General information
Most of the experiences offered take place outdoors in nature and are dependent on wind and weather conditions. Postponements can therefore always occur, even at short notice before the planned start. Safety is our top priority. Information regarding flight times, altitudes, and other flight data should always be understood as approximate.
13.1. Balloon rides
Balloon rides are highly dependent on wind and weather conditions. Specified launch sites cannot therefore be guaranteed and will be checked by the pilot at short notice and, if necessary, moved to an alternative site.
13.2. Paragliding flights
As paragliders fly without an engine, the flight times given are only approximate and should be understood as such. Deviations in flight time of +/- 25% are normal.
If the minimum flight duration of approx. 30 minutes is not reached during thermal flight, the passenger will be refunded the price difference to a panorama flight depending on the selected payment method. If payment was made by voucher, a voucher for the difference will be issued. Cash payment is only possible if the registration was made without a voucher.
Excluded from this rule are flights from:
- Rigi
- Fronalpstock Central Switzerland
- Stanserhorn
- Stockhorn
- all launch sites in Ticino
- Pilatus
- Zermatt
If the thermal flight is canceled by the passenger, the thermal flight is considered to have been flown in any case and no refund is due.
The passenger confirms that he/she does not suffer from any health problems (mental or physical) that could affect the safe operation of a passenger flight with a paraglider.
The passenger is aware that participation in a paragliding flight is associated with risks. The pilot has taken out liability insurance with a maximum cover of CHF 5 million. The liability of Adventurebase GmbH and the pilot for bodily injury and property damage suffered by the passenger during a paragliding flight is limited to a maximum of this amount.
Dates for passenger flights are agreed in advance (even at short notice). Changes to the date of the flight may be necessary due to weather conditions or for organizational reasons. The pilot makes the final decision as to whether a passenger flight is possible or not.
The passenger confirms that he/she is insured against the consequences of an accident (including during a paragliding flight). There is no accident insurance through Adventurebase GmbH or the pilot.
The pilot decides on the carrying of cell phones and cameras.
13.3. Aircraft type
Unless a specific aircraft type is specified in the offer, the pilot will select the most suitable type. The photos on the offer page and in the catalogs do not always show the aircraft type used.
13.4. Flight simulators
The customer agrees to take care of the simulator and not to make excessive control movements or apply excessive force. Damage and the associated inconvenience may be charged to the customer.
Depending on physical condition, simulators may cause nausea. In this case, this must be reported to the instructor immediately. Any resulting contamination and repair work may be charged to the customer.
14.1. Deliveries
Complaints regarding damage, loss, or poor packaging must be reported in writing to Flightbase and the carrier immediately upon receipt of the goods; hidden quantity discrepancies must be reported within 4 days of receipt of the goods.
14.2. Activities
If the customer has cause for complaint or suffers damage, this must be reported in writing to the organizing body (event organizer) within 5 days and confirmed. This confirmation does not constitute an admission of liability. The address of the responsible organizer can be requested from Flightbase. The organizer will endeavor to remedy the situation within the scope of the event and the possibilities available. If no or insufficient remedy is provided, or if the customer wishes to assert claims for damages, the claims must be submitted in writing to the organizer and in copy to Flightbase within 2 weeks after the contractual end of the activity. The complaint must be accompanied by the organizer's confirmation and any evidence. If the complaint is made late or not at all during the activity, or if the claim is submitted late, all claims will be forfeited.
The Flightbase offers are all considered non-risk sports. Non-occupational accident insurance (e.g. SUVA) and health insurance must be in place and are the responsibility of the participant and must be presented on site upon request. The participant confirms that he/she is insured against the consequences of an accident during the booked activity. There is no accident insurance through Adventurebase GmbH or the pilot/guide/experience partner.
Cancellation insurance is recommended and is the responsibility of the participant.
16.1. Compensation
Claims for damages arising from impossibility of performance, breach of contract, culpa in contrahendo, and tort are excluded both against us and against our vicarious agents, unless there is evidence of intent or gross negligence. Liability claims arising from a flight experience must be directed to the organizer. If a participant does not follow the instructions of the organizer, activity leader, etc., the organizer shall not be liable.
16.2. Private flights
Some of the flights offered by Flightbase are private flights within the meaning of the Aviation Ordinance SR 748.01 Art. 100. For these flights, insurance is mandatory to cover liability for personal injury and property damage. Whether a flight is operated as a private flight can be found in the offer text.
16.3. Liability
Flightbase acts exclusively as an intermediary between the customer and the partner company carrying out the flight. The contract for the provision of the flight service is concluded directly between the customer and the partner. Flightbase is therefore not liable for the provision of services, non-performance or poor performance, or for damage caused by the partner company or its auxiliary persons. Any claims arising from the performance of the activity must be addressed directly to the partner company. Flightbase will assist the customer in asserting their claims as far as possible.
Trogen AR is the exclusive place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship.
The legal relationship is subject to Swiss law. Should one or more provisions of these GTC be or become invalid and/or incomplete, the invalid and/or incomplete provision shall be replaced by a legally valid provision that comes as close as possible to the invalid and/or incomplete provision in terms of its effectiveness. The invalidity and/or incompleteness of one provision shall not affect the validity of the other provisions.
Passengers and participants from the USA or Canada expressly waive the right to a place of jurisdiction in the USA or Canada for any disputes arising from the activity and acknowledge that neither Adventurebase GmbH nor the guide/pilot/experience partner agree to a place of jurisdiction in the USA or Canada.
The original German version of the General Terms and Conditions is always legally binding.
